Verto Network Solutions, Inc. (Verto) being the Personal Information Controller (PIC), takes responsibilities under applicable privacy laws and regulations seriously and is committed to respecting the privacy rights and concerns of any individual (“Data Subjects”) as well as the confidentiality of personal data which you may provide to Verto or which Verto may collect from you (collectively, “Personal Data”), pursuant to Republic Act No. 10173 or the Data Privacy Act of 2012 and the implementing rules, regulations, and issuances of the National Privacy Commission.

Kindly read this Notice carefully to understand how we treat Personal Data. This policy statement tells you how we will collect, use your personal information, and the process in case you want Verto Network Solutions, Inc. to correct, update or remove your personal information you provided to us. 

Collection of Personal Data

The personal data to be collected may include, but not limited to, the following when you go to our “Contact Us” and “Careers” page in order to inquire or apply through our website. In addition, in connection with your accounts and transactions with us, we would be needing to collect some of your personal data such as the following:

• Personal information such as full name, citizenship, gender, educational background, and membership in organizations.
• Contact information such as home and office address, phone number, email address, Social Media accounts needed for communication such as Viber account and similar information.
• Work-related information such as position in the company, and government-issued identification numbers (Tax Identification, SEC Certificate Registration, Business Permit, License number, Business Bank Accounts and similar information).
• Your client’s information such as their name, email address, contact number, and other necessary data to proceed with the project (such as, but not limited to IP PBX, A2P Messaging, VoIP, Seat-leasing and Outsourcing Services).
• Such other information as it may deem reasonably necessary for business purposes.
• Any additional Personal Data that you may provide through your correspondence(s) with Verto shall also be considered and treated as Personal Data.

As Data Subject, you are responsible in ensuring that all such personal data you submitted to Verto Network Solutions, Inc. are accurate, complete and up-to-date. Verto reserves the right to request for documentation to verify the information you provided and equally reject the same should our verification yields unfruitful results.

Verto Network Solutions, Inc. may only collect your Personal Data if you voluntarily submitted your information. We may also collect personal data when you, other than using our website, interact with us via telephone calls (which may be recorded), letters, fax, face-to-face meetings, social media platforms, online chats and/or emails. Once you’re officially notified that your Personal Data has been collected at our end, your desire to maintain (i.e., update or delete) your submitted information, must be formally documented either through email or your signed letter sent to us. Upon receipt, we shall acknowledge and/or respond to you within a prescribed period.

In case you do not want to share your personal information with us, Verto cannot guarantee to be able to provide you with our services.

Verto does not require neither solicit any monetary expense, cash-out amount and/or financial obligation from anyone who fill-out our online forms in our website such that Verto will not collect any Credit/Debit Card information. 

Use and Disclosure of Personal Data

Verto may collect, use, disclose and/or process your personal data for, but not limited to, the following purposes:

• For identification and verification.
• To respond to your queries through our telephone and online platforms.
• To facilitate your use of our services.
• For the evaluation, approval, and confirmation of your registration as our distributor/partner/reseller.
• For sending bid requirements and requests for quotation.
• Sending invitations for partners or end-users training.
• To send notification about your concerns and updates.
• Signing of contracts.
• Delivery of goods.
• Billing.
• Contract tracing.
• Project documentations.
• To comply to a court order or as directed by a regulatory authority ordering the disclosure of the Personal Data.
• For providing you marketing and promotional materials in relations to Verto’s products and services.

We disclose Personal Data given, but not limited to, the following situations:

• When we are mandated by law.
• When responding to a request from law enforcement agencies or other government authorities.
• In order to comply to a court order or as directed by a regulatory authority ordering the disclosure of the Personal Data.
• Where the disclosure is needed for investigative purposes and/or legal proceedings.
• For any other analogous or similar circumstances.
• When we provide after-sales services, whereby service provider and brand manufacturers require the sharing of customer’s personal data, to help verify the ownership of a machine or gadget and use of the service. 

Retention and Disposal of Personal Data

Verto Network Solutions, Inc. and its authorized partners and/or affiliates shall retain your Personal Data for as long as the retention is required for the purposes for which we collected the Personal Data, the purposes described in this Policy, and for our business and legal purposes.

Your Personal Data shall be disposed in a secure manner that would prevent further processing, unauthorized access, or disclosure to any other party or to the public, or prejudice your interests as a Data Subject. 

Accessing, Correcting, and Deleting of Personal Data

You are entitled to certain rights in relation to the Personal Data, including the right to be informed of the processing of your Personal Data, to object to such processing, to access and correct your Personal Data, to request the deletion thereof, and to lodge a complaint before the National Privacy Commission in case of violation of your rights as Data Subject.

You may send us an e-mail at dataprivacy@vertonetworks.com to request access to, correct, and/or delete any Personal Data that you have provided to us. Please be advised, however, that if you ask us to delete, stop collecting, using, disclosing, or if you refuse to provide your Personal Data accurately, it could potentially restrict or totally prevent Verto’s ability to execute your transaction with us.

Also, we may not accommodate a request to correct and/or delete your Personal Data, if we believe that it will affect Verto’s rights to collect payments for any ordered and/or delivered goods, products, and services, or if it will violate any law or legal requirement. 

Protection and Security of Personal Data

Verto shall implement reasonable and appropriate technical, organizational, and physical security measures designed to protect the confidentiality, integrity, and availability of Personal Data you have submitted to us. These measures aim to secure personal data such from unauthorized destruction, access, alteration, disclosure, fraudulent use, and/or any other unlawful processing.

Verto only permits your data to be accessed or processed by our qualified and authorized personnel who hold such information under strict confidentiality. We also restrict access to information to anyone who would like to know/obtain such information without your written consent.

Any data security incident or breach shall be recorded and reported as required by law. Verto Network Solutions, Inc. will take all the necessary and reasonable steps to address such incident or breach and mitigate any negative effects of such incident or breach. If the incident affects your personal data, Verto will notify you of such incident immediately through the contact information you have submitted to us. 

Right to Privacy

As provided by the Act, and as a Data Subject, you may object to the processing of your personal data, request to access your personal information, and/or have it corrected, erased, or blocked on reasonable grounds. Verto will consider your request and reserves the right to deal with the matter in accordance with the law. Please review the “Collection of Personal Data” section in this policy as related to this clause.

Changes to the Privacy Policy

Verto Network Solutions, Inc. shall regularly review this Privacy Policy. We reserve the right to modify and change this Privacy Policy based on our business requirements and if there are any changes in the Data Privacy Act of 2012. Any changes in this Data Privacy Policy shall be published and communicated to all our customers through our website, email and/or via SMS to the mobile number you have provided us.

Consent

By continuing to use our website or any of our online facilities, services and any business transactions with us including providing us your Personal Data through any of our contact means, you signify your acceptance to this Policy and, therefore, grants us your consent for us to the collect, process, retain, disclose and dispose your personal information for the purposes stated herein.
